The Need for Safety on the Roads
The Philippines has seen a surge in the use of motorcycles for daily transportation and delivery services, resulting in an increase in motorcycle taxis and delivery services. Unfortunately, this has also led to a spike in motorcycle-related accidents. In just the first four months of 2023, the Philippine National Police-Highway Patrol Group (PNP-HPG) recorded around 4,000 motorcycle crashes, equating to half of the total incidents reported in 2022. This escalation is concerning, riders must exercise caution, follow safety regulations, and improve road safety. The Motorcycle Development Program Participants Association (MDPPA) is actively working to educate riders about the key laws they must adhere to.
Important Laws for Motorcycle Riders
Land Transportation and Traffic Code (RA 4136)
This law oversees the registration and operations of motor vehicles, as well as the licensing of owners, dealers, conductors, and drivers. It encompasses rules for driver’s licenses, general traffic rules, vehicle registration and operation, traffic enforcement and penalties, and traffic safety education. Additionally, the LTO Memorandum Circular 2019-2176, in line with RA4136, enforces a standardized Driver Education to bolster safety awareness and effective communication on public roads. Violations of this law result in fines and penalties.
Motorcycle Helmet Act of 2009 (RA 10054)
This legislation requires all motorcycle riders to wear approved protective helmets and sets penalties for failure to comply. It is designed to shield riders from the severe consequences of accidents and crashes and to encourage the correct use of helmets. Penalties for non-compliance range from Php1,500 for the first offense to Php10,000 and confiscation of the driver’s license for the fourth and subsequent offenses.
Anti-Drunk and Drugged Driving Act of 2013 (RA 10586)
This law targets driving under the influence of alcohol, dangerous drugs, and other similar substances. Penalties range from a Php20,000 to Php80,000 fine and three months imprisonment for violations not resulting in physical injuries or homicide, to a Php300,000 to Php500,000 fine and penalties under the Revised Penal Code for violations resulting in death.
Children’s Safety on Motorcycles Act of 2015
This regulation forbids driving with a child on board on busy public roads. Penalties range from Php3,000 for the first offense to Php10,000 and immediate cancellation of the driver’s license for the third and subsequent offenses.
Anti-Distracted Driving Act (RA 10913)
This legislation prohibits riders and drivers from using gadgets while on the road. Penalties range from Php5,000 for the first offense to Php20,000 and cancellation of the driver’s license for the fourth and subsequent offenses.
Motorcycle Crime Prevention Act (RA 11235)
This law mandates larger, readable, and color-coded number plates and identification marks for motorcycles to prevent and penalize the use of motorcycles in criminal activities. Failure to comply results in imprisonment, a Php20,000 to Php50,000 fine, or both.
